Agreement to Terms
Welcome to BWP (Business Website Professional). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and BWP (“we,” “us,” or “our”) regarding your use of our services.
By accessing our website, engaging our services, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms apply to all services offered by BWP, including but not limited to:
- Website development and design
- Email hosting services
- Domain registration and management
- Web hosting services
- Website maintenance and support
- Newsletter subscription services (Free and Pro tiers)
Service Packages
BWP offers three primary service packages for website development:
Bizz Ready Package
Price: Rp 4.500.000 (first year) / Rp 1.500.000 (renewal)
Includes:
- Professional template-based website design
- Free copywriting for website content
- Brand customization (colors, fonts, logos)
- 2 rounds of revisions
- Mobile-responsive design
- SSL Certificate & Basic SEO setup
- 1 business email account
- 15GB hosting storage
- Free .com domain (first year)
- 5 minor updates per month
- Support with max 24-hour response time
- 3-day delivery guarantee
Bizz Growth Package
Price: Rp 6.500.000 (first year) / Rp 2.500.000 (renewal)
Includes all Bizz Ready features plus:
- Unlimited pages
- Custom page structure
- Full website adaptation to business needs
- Up to 3 business email accounts
- Increased hosting storage
- Free website migration (if applicable)
- 1 blog article per month (12 articles per year)
- Proactive website monitoring
- Priority support
Bizz Signature Package
Price: Starting from Rp 15.000.000 (first year) / Rp 4.000.000 (renewal)
Includes all Bizz Growth features plus:
- 100% custom UI/UX design from scratch
- Unique brand-specific structure
- Fully custom features and functionality
- Unlimited business email accounts
- Premium hosting with dedicated resources
- Unlimited minor updates
- 2 blog articles per month (24 articles per year)
- 1 major update per year (design refresh or new feature)
- Dedicated account manager
- Monthly reporting and consultation
- Priority support with faster response times
Service Delivery and Timeline
Delivery Timeline
BWP guarantees website delivery within 3 business days from the date of:
- Receipt of 50% deposit payment
- Receipt of complete project brief and materials
- Client confirmation to proceed
Client Responsibilities
To ensure timely delivery, the Client agrees to:
- Provide complete and accurate information in the project brief
- Supply all necessary content, images, logos, and branding materials
- Respond to BWP inquiries within 24 hours during business days
- Provide feedback and approval in a timely manner
Revisions
- Bizz Ready and Bizz Growth: 2 rounds of revisions included
- Bizz Signature: Unlimited revisions during development
- Revisions requested after project completion may incur additional fees
- Significant scope changes may require a new project proposal and pricing
Payment Terms
Payment Structure
Initial Year:
- 50% deposit required to begin work
- 50% balance due before website launch
Renewal (Year 2 onwards):
- Full payment due at the beginning of each renewal period
- Grace period of 7 days after renewal date
Payment Methods
We accept payment via:
- Bank transfer (Indonesia)
- E-wallets (GoPay, OVO, Dana, etc.)
- Credit/Debit cards (via payment gateway)
- Virtual accounts
Business Transfers
In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred to the acquiring entity. We will notify you of any such change and provide options regarding your information.
Late Payment
If payment is not received within the grace period:
- Services may be suspended or terminated
- Website may be taken offline
- Email services may be discontinued
- Late fees of Rp 100.000 per week may apply
Refund Policy
Before Development Begins:
- Full refund available minus 10% administrative fee
After Development Begins:
- No refunds available
- Work completed to date will be delivered to Client
Renewal Payments:
- No refunds for renewal payments after the service period begins
Intellectual Property Rights
Client-Provided Content
The Client retains all rights to:
- Business name, logos, and trademarks
- Content, text, and images provided by Client
- Product descriptions and marketing materials
BWP-Created Work
Upon full payment, the Client receives:
- Full ownership of custom code and design created specifically for the Client
- Rights to use, modify, and distribute their website
- All copywriting created by BWP for the Client’s website
BWP retains:
- Rights to template frameworks and base code
- Rights to reuse general techniques and methodologies
- Rights to display the website in our portfolio (unless Client explicitly requests otherwise)
Hosting and Maintenance
Hosting Services
BWP provides web hosting as part of all service packages, including:
- Server space for website files
- Bandwidth for website traffic
- Email hosting services
- SSL Certificate
- Automated backups
Uptime Guarantee
BWP strives to maintain 99.9% uptime. However, we cannot guarantee uninterrupted service due to:
- Scheduled maintenance (notified 72 hours in advance)
- Force majeure events (natural disasters, power outages, etc.)
- Third-party service provider issues
- DDoS attacks or security incidents
Monthly Update Quota
- Bizz Ready & Growth: 5 minor updates per month
- Bizz Signature: Unlimited minor updates
Definition of Updates
Minor Updates (included in quota):
- Text or content changes on existing pages
- Image replacements (up to 5 images per update)
- Contact information updates
- Minor design adjustments (colors, fonts, spacing)
- Bug fixes and error corrections
Major Updates (charged separately):
- New page creation
- New feature implementation
- Design overhauls or redesigns
- Third-party integrations
- E-commerce functionality
Support Services
Support Channels
Clients can reach BWP support via:

Response Times
- Standard response: Maximum 24 hours
- Business hours (Mon-Fri, 08:00-17:00 WIB): Faster response (typically within a few hours)
- Urgent issues: Prioritized immediately
- Bizz Signature: Priority support with faster response times
Client Obligations
Lawful Use
The Client agrees to use BWP services only for lawful purposes. The Client must not:
- Use the website for illegal activities
- Publish defamatory, offensive, or harmful content
- Violate intellectual property rights of others
- Distribute malware, viruses, or harmful code
- Engage in spam or unsolicited marketing
- Attempt to hack, breach, or compromise security
Content Responsibility
The Client is solely responsible for:
- Accuracy and legality of all content provided
- Obtaining necessary permissions for images, text, and materials
- Compliance with applicable laws and regulations
- Privacy policy and terms of service for their own website
Termination
Termination by Client
The Client may terminate services at any time by providing 30 days written notice. Upon termination:
- No refunds for unused portions of the service period
- Website files and database backup will be provided within 7 days
- BWP will transfer domain ownership to Client (if requested)
- Email services will be discontinued after notice period
Termination by BWP
BWP reserves the right to terminate services immediately if the Client:
- Fails to make payment within grace period
- Violates these Terms of Service
- Engages in illegal activities
- Causes harm to BWP’s systems or reputation
- Abuses support services or staff
Limitation of Liability
To the fullest extent permitted by law:
- BWP shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- BWP’s total liability shall not exceed the amount paid by Client for services in the 12 months preceding the claim
- BWP is not responsible for loss of profits, revenue, data, or business opportunities
- BWP is not liable for damages resulting from Client’s misuse of services
- BWP is not responsible for third-party service failures beyond our control
Warranties and Disclaimers
BWP Warranties
BWP warrants that:
- Services will be provided with reasonable care and skill
- Website will function substantially as described in the agreed specifications
- We have the right to provide all services offered
Disclaimers
Except as expressly stated, services are provided “as is” without warranties of any kind. BWP does not warrant:
- Uninterrupted or error-free service
- Specific business results or outcomes
- Compatibility with all third-party services
- Complete security against cyber threats
Newsletter Services
Free Tier (BWP Insider)
Price: Free
Includes:
- Weekly newsletter with latest blog article
- Tips and actionable advice
- Occasional promotional offers
- Access to blog article archive
Paid Tier (BWP Pro)
Price: Rp 99.000 per month or Rp 999.000 per year
Includes all Free Tier benefits plus:
- 1 exclusive article per week (not published on blog)
- 1 template or checklist per week
- 1 deep-dive guide per month (10-20 pages)
- 1 free 30-minute consultation per month
- Early access to promotions (10-15% discount)
- Private community access (Telegram/WhatsApp group)
- Priority email support
Changes to Terms
BWP reserves the right to modify these Terms at any time. Changes will be effective upon:
- Posting the updated Terms on our website
- Email notification to Clients for material changes
Continued use of services after changes constitutes acceptance of the new Terms.
Governing Law and Disputes
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
Dispute Resolution
In the event of a dispute:
- Parties agree to first attempt resolution through good-faith negotiation
- If negotiation fails, parties may pursue mediation
- As a last resort, disputes will be resolved through arbitration or courts in Indonesia
Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between the parties.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Force Majeure
BWP shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
